ADDO EXPRESSMARK COMPETITION TERMS AND CONDITIONS
1. PROMOTER
The Promoter of this competition is Expressmark, a division of Kaap Agri Bedryf Limited with registration number: 1995/000336/06, a public company, including its holding company, KAL Group Limited with registration number 2011/113185/06 (“KAL Group”), as well as all its subsidiaries and associate companies (as amended from time to time), registered under and in accordance with the laws of South Africa, with principal place of business situated at 1 Westhoven Street, Paarl, 7646, South Africa (“Kaap Agri”).
2. PARTICIPANTS
Participants who enter the competition subject themselves to the rules of the competition and unconditionally agree to the terms and conditions set out in this document.
3. WHO IS ELIGIBLE TO COMPETE?
3.1. To participate in the Competition, the Participant must be a citizen or a permanent resident of South Africa, be in possession of a valid South African Identity Document, or a Passport, and must be 18 years or older as at the date on which the Participant enters the Promotional Competition. Should the Participant entering be a juristic person or a trust the person representing the juristic person or trust must be 18 years or older as at the date on which the Participant enters the Competition and be fully authorized in terms of an appropriate resolution by the juristic person or trust.
3.2. In order to participate, eligible participants must spend a minimum of R250 at Addo Expressmark and place their original till slip, with their contact details into the competition box provided.
3.3. 5.2. This must be done on or before midnight on the 15ht of July 2023 to be eligible.
3.4. Only one entry per Participant is permitted.
4. WHO IS EXCLUDED?
4.1. Any individual who is a director of the Promotor, or of any of the companies within the KAL Group, or their immediate family (spouse and children) or a juristic person or trust which such director has the ability to control, individually or taken together with their immediate family, or a trust of which such director is a beneficiary.
4.2. The Senior Manager: Brand & Communications and members of the Kaap Agri Internal Audit team may not partake in the Competition.
4.3. Kaap Agri’s promotional, advertising and digital consultants may also not participate in the Competition.
5. HOW TO ENTER
5.1. In order to enter, eligible contestants must spend a minimum of R250 at Addo Expressmark and place their original till slip, with their contact details into the competition box provided. They must do this between 30 June 2023 and midnight, July 15 to be eligible.
5.2. 5.2. Only one entry per participant is allowed.
6. DURATION OF COMPETITION
6.1. The duration of the Competition is from 30 June 2023 until 15 July 2023.
6.2. No entries will be accepted after 23h59 on 15 July 2023.
7. THE PRIZE
7.1. Four participants stand a chance to win a R500 Agrimark voucher.
7.2. The prize is non-transferable and may not be exchanged for cash.
7.3. The prize is valid for 3 years from receipt.
7.4. No extras are included in the prize.
7.5. The Participant will be required to collect their prize at their nearest Agrimark store.
8. DRAWS
8.1. All valid entries will be entered into a random draw selection to determine the winner.
8.2. The random draw selection process to determine the winner will occur under the supervision of Kaap Agri’s Internal Audit Department.
8.3. Winners will be contacted on the cell phone number and/or email address given on the till slip and the winners will need to confirm that they agree to the Terms and Conditions of the Competition set out in this document.
8.4. The random draw selection process for the prizes will occur under the supervision of Kaap Agri’s Internal Audit department.
8.5. The winners may be announced on www.facebook.com/agrimark and www.instagram.com/agrimark, and in any other manner deemed fit by Kaap Agri or Expressmark.
8.6. In the event of the Promoter not being able to contact the finalists, the Promoter reserves the right to draw new winner.
8.7. If any of the Terms and Conditions of the Competition are not upheld, Kaap Agri will consider the entry null and void and another winner will automatically be selected.
9. JUDGE’S DECISION
The Promoter’s decision regarding any aspect of the Competition is final and no discussion or correspondence about the outcome of the Competition will be entered into.
10. INDEMNITY
10.1. The Promoter will not be responsible, and disclaim any and all liability, for any loss, liability, injury, expense or damage (including direct, indirect, incidental, punitive or consequential loss) of any nature whatsoever, whether arising from contract, negligence or any other cause, which is suffered by any Participant or any other third party as a result of his/her participation in this Competition and/or by any action taken by the Promoter or any of its affiliates in accordance with these terms and conditions.
10.2. Participants accept the prizes at their own risk and indemnify the Promoter, and the organisers from any claims that may arise from the use or service of the prize and undertake not to issue any claims against Kaap Agri for damage or injury that may result from the acceptance or usage of the prize or from their participation in the Competition.
11. DATA PRIVACY AND CONSENT
11.1. We respect your privacy and acknowledge that this Competition will contain personal details, which may belong to you or others (“Personal Information”). By participating in this Competition, you expressly provide Kaap Agri with the necessary consent to process and further process the Personal Information contained therein which processing will be done in accordance with POPIA, the Kaap Agri POPIA Privacy Policy and the Kaap Agri standard section 18 informed consent documentation which is available under the legal section of our website.
11.2. Kaap Agri may use winners’ personal information and photos for promotional purposes, without compensating them, if it relates to the Competition. By winning any prize in this Competition, Participants agree to co-operate with Kaap Agri and Expressmark for promotional purposes.
11.3. Should you withdraw your consent at any point in time, you understand that your entry will no longer be valid, and if you are selected as a winner, you will unconditionally and wholly forfeit your prize.
12. GENERAL
12.1. The Promoter reserves the right to vary, postpone, suspend, or cancel this Competition or any aspect thereof, without notice, at any time, for any reason whatsoever, which the Promoter deems necessary, in their sole determination. In the event of such variation, postponement, suspension or cancellation, each Participant agrees to waive any rights, interests and expectations that he/she may have in terms of this Competition and acknowledge that he/she will have no recourse against the Promoter.
12.2. These Terms and Conditions are governed by South African law and the South African courts shall have sole and exclusive jurisdiction in respect of all matters (including disputes) arising from these Terms and Conditions.
